§ 1 General provisions

§ 1 Postanowienia Ogólne

Freelance Management Group is a limited liability partnership registered under the laws of England and Wales with company number OC443813 (the "company", "we", "us" or "our"). Our registered address is at 411 Oxford Street, London, W1C 2PE, United Kingdom (hereinafter referred to as the "Contractor"), declares that these Regulations define the rules for concluding and performing contracts between the Contractor and the client Contractors (hereinafter referred to as the "Ordering Party").

Freelance Management Group jest partnerstwo z ograniczoną odpowiedzialnością zarejestrowaną zgodnie z prawem Anglii i Walii pod numerem OC443813 z siedzibą w Londynie, 411 Oxford Street, W1C 2PE, Wielka Brytania (zwana dalej „Wykonawcą") oświadcza, iż niniejszy Regulamin określa zasady zawierania i wykonania umów pomiędzy Wykonawcą a klientem Wykonawcy (zwanym dalej jako „Zamawiający").

These Regulations also define the general terms, conditions and method of providing Services by electronic means via the Contractor's website available at: pisanie24.online (hereinafter referred to as the "Website").

Niniejszy Regulamin określa również ogólne warunki, zasady oraz sposób świadczenia Usług drogą elektroniczną za pośrednictwem strony internetowej Wykonawcy dostępnej pod adresem: pisanie24.online (dalej jako „Strona internetowa").

The subject of the Contractor's activity are editorial and editorial services in various fields of science as well as information and advisory services. The Contractor provides services in the field of writing scientific studies, constituting only a model or a starting point for writing own works by the Ordering Party. All works written by the Contractor may be used for information purposes only and in a manner that does not infringe the provisions of the copyright law and the 1988 Copyright, Designs and Patents Act.

Przedmiotem działalności Wykonawcy są usługi redakcyjno-edytorskie z różnych dziedzin nauki oraz usługi informacyjno-doradcze. Wykonawca świadczy usługi z zakresu pisania opracowań naukowych, stanowiących wyłącznie wzór bądź bazę wyjściową do pisania własnych prac przez Zamawiającego. Wszystkie prace napisane przez Wykonawcę mogą być wykorzystywane wyłącznie w celach informacyjnych i w sposób nienaruszający przepisów prawa autorskiego oraz Ustawy o prawie autorskim, wzorów i patentów z 1988 roku.

All teaching materials, analyzes, scientific studies or any other texts are made at the individual request of the Ordering Party, in accordance with the provided requirements and guidelines. The Contractor declares that the prepared materials are not subject to further resale and are only at the disposal of the Ordering Party.

Wszelkie materiały dydaktyczne, analizy, opracowania naukowe czy jakiekolwiek inne teksty realizowane są na indywidualne zlecenie Zamawiającego, zgodnie z przekazanymi wymaganiami i wytycznymi. Wykonawca oświadcza, że przygotowane materiały nie podlegają dalszej odsprzedaży i są wyłącznie do dyspozycji Zamawiającego.

Unless the Regulations provide for the form of making statements and communication between the parties, communication via e-mail is accepted.

O ile w Regulaminie nie wskazano formy składania oświadczeń i komunikacji między stronami, przyjmuje się komunikację za pośrednictwem wiadomości e-mail.

Ordering the service by the Ordering Party is tantamount to accepting these Regulations in full. The refusal to accept these Regulations shall result in the refusal to conclude a contract with the Ordering Party.

The information contained on the Website does not constitute an offer within the meaning of the Civil Code.

All orders are carried out mostly in Polish.

Zlecenie wykonania usługi przez Zamawiającego jest równoznaczne z akceptacją niniejszego Regulaminu w całości. Odmowa zaakceptowania niniejszego Regulaminu skutkuje odmową zawarcia umowy z Zamawiającym.

Informacje zawarte na Stronie internetowej nie stanowią oferty handlowej w rozumieniu Kodeksu Cywilnego.

Wszystkie zlecenia realizowane są w większości w języku polskim.

§ 2 Order fulfillment

§ 2 Realizacja zamówienia

Zamawiający może złożyć zamówienie na kilka sposobów:

The order completion date as well as the form and date of payment are agreed individually between the Contractor and the Ordering Party.

Termin realizacji zlecenia oraz forma i termin płatności ustalane są indywidualnie pomiędzy Wykonawcą a Zamawiającym.

The order completion date agreed by the parties is the forecast date. The order fulfillment period may be extended in the event of reasons beyond the control of the Contractor. The Contractor shall notify the Ordering Party about the extension of the order completion date.

Ustalony przez strony termin realizacji zlecenia jest terminem prognozowanym. Termin realizacji zamówienia może ulec wydłużeniu w przypadku wystąpienia przyczyn niezależnych od Wykonawcy. Wykonawca powiadomi Zamawiającego o wydłużeniu terminu wykonania zlecenia.

The material is made on the basis of available (also indicated by the Ordering Party) book materials and internet resources.

Materiał realizowany jest na podstawie dostępnych (również wskazanych przez Zamawiającego) materiałów książkowych i zasobów internetowych.

The order is processed as follows:

Realizacja zlecenia przebiega w następujący sposób:

The contracting authority places an order through one of the three channels specified in point 1 of this paragraph. In the order, the Ordering Party shall indicate the guidelines regarding the order.

Zamawiający składa zamówienie za pośrednictwem jednego z trzech kanałów określonych w pkt 1 niniejszego paragrafu. W zamówieniu Zamawiający wskazuje wytyczne dotyczących zamówienia.

Within 48 hours of sending the order, the Contractor verifies the possibility of performing the ordered service and informs the Principal about it by sending him the Order Confirmation - constituting Appendix No. 1 to the Regulations. The order confirmation contains essential elements of the contract, including the subject of the service, the date of the service, the cost of the service, the method of payment, as well as the Ordering Party's guidelines on how to perform the contract, provided that the Ordering Party has provided such guidelines in the order.

W terminie 48 godzin od przesłania zamówienia Wykonawca weryfikuje możliwość wykonania zamówionej usługi i informuje o tym Zleceniodawcę, przesyłając mu Potwierdzenie Zamówienia – stanowiące Załącznik nr 1 do Regulaminu. Potwierdzenie zamówienia zawiera istotne elementy umowy, w tym przedmiot usługi, termin wykonania usługi, koszt usługi, sposób płatności, jak też wytyczne Zamawiającego dotyczące sposobu wykonania umowy, o ile Zamawiający zgłosił takie wytyczne w zamówieniu.

Within 24 hours of receiving the Order Confirmation from the Contractor, the Ordering Party should accept its content by e-mail. Accepting the Order Confirmation is tantamount to accepting these Regulations.

W ciągu 24 godzin od otrzymania Potwierdzenia Zamówienia od Wykonawcy, Zamawiający powinien zaakceptować jego treść w drodze wiadomości e-mail. Akceptacja Potwierdzenia Zamówienia jest jednoznaczna z akceptacją niniejszego Regulaminu.

After accepting the Order Confirmation, the Ordering Party shall pay the remuneration or its first tranche - in accordance with the arrangements indicated in the Order Confirmation. The contract is concluded between the parties on the day of payment.

Po akceptacji Potwierdzenia Zamówienia Zamawiający dokonuje wpłaty wynagrodzenia lub jego pierwszej transzy - zgodnie z ustaleniami wskazanymi w Potwierdzeniu Zamówienia. Z dniem dokonania wpłaty dochodzi pomiędzy stronami do zawarcia umowy.

After receiving the remuneration or its first tranche, the Contractor starts the service. The Ordering Party acknowledges that in the event of delay in payment within the agreed deadline, the order completion date indicated in the Order Confirmation will be postponed.

Po otrzymaniu wynagrodzenia lub jego pierwszej transzy Wykonawca rozpoczyna realizację usługi. Zamawiający przyjmuje do wiadomości, że w przypadku opóźnienia wpłaty w ustalonym terminie przesunięciu ulega termin realizacji zamówienia wskazany w Potwierdzeniu Zamówienia.

If the service is carried out in stages, the next stage of service implementation follows with each subsequent stage of payment. After receiving 1 (first) part of the work, the Contractor shall make corrections according to the Employer's requirements.

W przypadku gdy usługa jest realizowana etapami, z każdym kolejnym etapem płatności następuje kolejny etap realizacji usługi. Po otrzymaniu 1 (pierwszej) części pracy Wykonawca nanosi poprawki według wymagań Zamawiającego.

If the service is provided once, the Contractor sends the Ordering Party the entire study.

W przypadku gdy usługa jest realizowana jednorazowo, Wykonawca przesyła Zamawiającemu całość opracowania.

The contracting authority is obliged to indicate the procurement guidelines in detail. Failure to comply with this formality means that the complaints regarding the order will not be processed.

Zamawiający jest zobowiązany do wskazania wytycznych dotyczących zamówienia w sposób szczegółowy. Niedopełnienie tej formalności powoduje, że reklamacje dotyczące zlecenia nie będą realizowane.

The Contractor reserves that only the guidelines indicated in the Order Confirmation are binding on the Contractor. The contracting authority has the right to free of charge corrections if the guidelines are not met.

Wykonawca zastrzega, iż tylko wytyczne wskazane w Potwierdzeniu zamówienia są wiążące dla Wykonawcy. Zamawiający ma prawo do nieodpłatnych poprawek, jeśli wytyczne nie zostaną spełnione.

§ 3 Rules for the use of scientific materials

§ 3 Zasady użytkowania materiałów naukowych

The materials prepared and made available by the Contractor may only be an inspiration for creating independent studies, because they are only exemplary and auxiliary.

Materiały przygotowane i udostępniane przez Wykonawcę mogą stanowić wyłącznie inspirację do tworzenia samodzielnych opracowań, bowiem mają one charakter wyłącznie wzorcowy i pomocniczy.

The Ordering Party declares that it will use it only in accordance with the law in force in the United Kingdom or any other countries where it is supposed to be used.

Zamawiający materiał naukowy oświadcza, że będzie go wykorzystywał wyłącznie zgodnie z prawem obowiązującym w WIelkiej Brytanii lub innych krajach, w których ma być używany.

Studies prepared by the Contractor or fragments of these studies may not be presented by the Employer at universities as their own, as it is an illegal activity. The Contractor does not consent to the Ordering Party's presentation of the prepared studies to third parties, universities and institutions as the Ordering Party's own works.

Opracowania wykonane przez Wykonawcę lub fragmenty tych opracowań nie mogą być przez Zamawiającego przedstawiane na uczelniach jako swoje własne, ponieważ jest to działanie niezgodne z prawem. Wykonawca nie wyraża zgody na przedstawienie przez Zamawiającego przygotowanych opracowań osobom trzecim, uczelniom i instytucjom jako prac własnych Zamawiającego.

In the event of a breach by the Ordering Party of the provisions of these Regulations and allegations of illegal use of the published studies, the Contractor reserves the right to immediately terminate the cooperation with the Ordering Party, without the obligation to return the remuneration paid so far.

W przypadku naruszenia przez Zamawiającego postanowień niniejszego Regulaminu oraz przypuszczeń nielegalnego wykorzystywania udostępnionych opracowań, Wykonawca zastrzega sobie prawo do natychmiastowego zakończenia współpracy z Zamawiającym, bez obowiązku zwrotu uiszczonego dotychczas wynagrodzenia.

The contractor is not responsible for the improper or unlawful use of the materials provided.

Wykonawca nie ponosi odpowiedzialności za niewłaściwe lub niezgodne z prawem wykorzystanie udostępnionych materiałów.

§ 4 Rights and obligations of the Contractor and the Ordering Party

§ 4 Prawa i obowiązki Wykonawcy i Zamawiającego

The contracting authority is obliged to pay the remuneration in a timely manner and to provide all detailed guidelines.

Zamawiający zobowiązany jest do terminowego opłacenia wynagrodzenia oraz do podania wszelkich szczegółowych wytycznych.

The Contractor declares that in order to carry out the contract, he will commission Editors of his choice to perform it.

Wykonawca oświadcza, iż w celu realizowania zamówienia, zleci jego wykonanie wybranym przez siebie Redaktorom.

As part of the execution of the order, the Ordering Party does not acquire proprietary copyrights to the study, nor does it obtain a license authorizing the dissemination of the study. The Ordering Party is entitled to use the study only for the purpose indicated in these Regulations.

W ramach realizacji zlecenia Zamawiający nie nabywa autorskich praw majątkowych do opracowania ani nie uzyskuje licencji uprawniającej do rozpowszechniania opracowania. Zamawiający jest uprawniony do korzystania z opracowania jedynie w celu wskazanym w niniejszym Regulaminie.

§ 5 Complaints

§ 5 Reklamacja

After the Contractor prepares a written text on the commissioned subject, the Contractor sends it to the Employer. The Employer may, within 30 days from the date of receipt of the work, in writing or electronically, provide the Contractor with reservations as to the quality of the work in order for the Contractor to make one-off, free corrections. The parties agree that if the Ordering Party does not present any substantiated objections within the time limit specified in this paragraph, it is considered that the Contractor has performed the Services of appropriate quality and in full, and the Ordering Party has accepted them.

Po sporządzeniu przez Wykonawcę tekstu pisemnego na zlecony temat, Wykonawca przesyła go do Zamawiającego. Zamawiający może w ciągu 30 dni od daty otrzymania pracy w formie pisemnej lub elektronicznej przekazać Wykonawcy zastrzeżenia co do jakości pracy w celu wprowadzenia przez Wykonawcę jednorazowych, bezpłatnych poprawek. Strony uzgadniają, że jeżeli Zamawiający nie przedstawi żadnych uzasadnionych zastrzeżeń w terminie określonym w niniejszym paragrafie, uznaje się, że Wykonawca wykonał Usługi o odpowiedniej jakości i w całości, a Zamawiający je zaakceptował.

The basis for considering the complaint is the fact that the Contractor did not take into account the guidelines received from the Ordering Party, indicated in the Order Confirmation.

Podstawą rozpatrzenia reklamacji jest fakt nieuwzględnienia przez Wykonawcę wytycznych otrzymanych od Zamawiającego, wskazanych w Potwierdzeniu Zamówienia.

The Ordering Party is obliged to show in detail all reservations to the service performed by the Contractor in relation to the relevant paragraphs, chapters, and paragraphs that require editing and correction in accordance with the guidelines.

Zamawiający zobowiązany jest do szczegółowego wykazania wszystkich zastrzeżeń do wykonanej przez Wykonawcę usługi w odniesieniu do odpowiednich paragrafów, rozdziałów, akapitów, które wymagają zredagowania i poprawienia zgodnie z wytycznymi.

After the Contractor has made corrections based on the comments presented in the Awarding Entity's reservations, the Contractor shall submit the corrected text. After submitting the corrected text, any other comments not previously submitted will be corrected by the Contractor for an additional fee at the cost of the Ordering Party.

Po dokonaniu poprawek przez Wykonawcę na podstawie uwag przedstawionych w zastrzeżeniach Zamawiającego, Wykonawca przekazuje poprawiony tekst. Po przekazaniu poprawionego tekstu wszelkie inne uwagi, nie zgłoszone uprzednio będą poprawiane przez Wykonawcę za dodatkową opłatą na koszt Zamawiającego.

If the comments on the quality of work contained in the re-reservations have not been specified in the first reservations, and the Ordering Party refuses to pay additional fees for making appropriate corrections to the text, it is considered that the Services were provided by the Contractor of an appropriate quality and are accepted by the Ordering Party.

Jeżeli uwagi dotyczące jakości pracy zawarte w ponownych zastrzeżeniach nie zostały określone w pierwszych zastrzeżeniach, a Zamawiający odmawia uiszczenia dodatkowych opłat za dokonanie odpowiednich poprawek do tekstu, uważa się, że Usługi były świadczone przez Wykonawcę w odpowiedniej jakości oraz są zaakceptowane przez Zamawiającego.

If the Services are provided in parts / stages and the payment takes place after the completion of each stage, the fact of payment for a given stage means its acceptance by the Ordering Party. If the Ordering Party accepts the provided Services or their part, any further changes, corrections of the written work or the accepted part are made for a separate fee agreed upon by the Parties.

Jeżeli Usługi świadczone są częściami/etapami i płatność następuje po zakończeniu każdego etapu, fakt zapłaty za dany etap oznacza jego akceptację przez Zamawiającego. W przypadku akceptacji przez Zamawiającego świadczonych Usług lub ich części, wszelkie dalsze zmiany, poprawki pracy pisemnej lub zaakceptowanej części dokonywane są za odrębną opłatę ustaloną w porozumieniu Stron.

After the lapse of 30 days from the date of handing over the entire work or after payment by the Ordering Party for a particular stage of work - the Contractor has the right to refuse to make corrections or demand an additional fee for making corrections.

Po upływie terminie 30 dni od dnia przekazania całości pracy bądź po dokonaniu płatności przez Zamawiającego za poszczególny etap pracy – Wykonawca ma prawo odmówić dokonania poprawek lub domagać się naliczenia dodatkowej opłaty za wykonanie poprawek.

§ 6 Payment

§ 6 Płatność

The Contractor declares that the price for the performance of the service may be specified in the following currencies: Great British Pound (GBP), Polish zloty (PLN), US dollar (USD), euro (EUR), Brazil Real (BRL).

Depending on individual arrangements between the Contractor and the Ordering Party, the payment may be made once or in tranches, which will be indicated in the Order Confirmation.

The Contractor allows the following forms of payment in remuneration:

a) Payment by credit/debit card or Apple/Google Pay

b) Payment in the online payment system on Przelewy24

In the event of delay in payment, the Contractor is entitled to charge statutory interest for the delay for each day of delay.

Wykonawca oświadcza, że cena za wykonanie usługi może zostać określona w następujących walutach: Brytyjski funt (GBP) polski złoty (PLN), dolar amerykański (USD), euro (EUR), Real brazylijski (BRL).

W zależności od indywidualnych ustaleń pomiędzy Wykonawcą a Zamawiającym płatność może być dokonana jednorazowo lub w transzach, co zostanie wskazane w Potwierdzeniu Zamówienia.

Wykonawca dopuszcza następujące formy płatności w wynagrodzenia:

a) Opłata credit/debit kartą płatniczą lub Apple/Google Pay

b) Płatność w systemie płatności internetowych w serwisie Przelewy24

W przypadku opóźnienia w płatności Wykonawca uprawniony jest do naliczania odsetek ustawowych za opóźnienie za każdy dzień opóźnienia.

§ 7 Withdrawal from the contract

§ 7 Odstąpienie od umowy

By concluding a distance contract, the contracting authority has the option to withdraw from the contract without giving any reason within 14 calendar days from the date of the contract. The declaration of withdrawal from the contract should be sent in electronic form to the Contractor's e-mail: info@pisanie24.online.

The template of the declaration of withdrawal from the Agreement is attached as Appendix 2 to the Regulations.

The Ordering Party acknowledges that he is not entitled to withdraw from the contract if the Contractor has already performed the service with the consumer's consent.

Zamawiający zawierając umowę na odległość, ma możliwość odstąpić od umowy bez podawania przyczyny w terminie 14 dni kalendarzowych od dnia zawarcia umowy. Oświadczenie o odstąpieniu od umowy należy przesłać w formie elektronicznej na e-mail Wykonawcy: info@pisanieprac.online.

Wzór oświadczenia o odstąpieniu od Umowy stanowi załącznik nr 2 do Regulaminu.

Zamawiający przyjmuje do wiadomości, że uprawnienie do odstąpienia od umowy nie przysługuje mu, jeżeli Wykonawca wykonał już usługę za zgodą konsumenta.

§ 8 Force Majeure

§ 8 Siła wyższa

The parties are released from liability for non-performance or improper performance of obligations under this Agreement, if they arose as a result of force majeure.

For the purposes of this Agreement, force majeure is considered to be all circumstances that could not have been foreseen or avoided, including: natural disasters (fire, earthquake, landslides, flood, storm or other atmospheric phenomena), pandemics, epidemics, wars, uprisings , revolts, strikes or decisions or normative acts of government authorities, regulation, restriction, prohibitions or other state interference, explosions and other damage to production and distribution devices, and nationwide failures of the Internet network.

A party to the contract that fails to meet or expects that it will not meet its obligations under the contract (taking into account all known facts) due to force majeure, should immediately inform the other party to the contract and make every effort to reverse such a state or its consequences. and their removal.

Strony są zwolnione z odpowiedzialności za niewykonanie lub nienależyte wykonanie zobowiązań wynikających z niniejszej Umowy, jeżeli powstały one w wyniku działania siły wyższej.

Dla potrzeb niniejszej Umowy za siłę wyższą uważa się wszystkie okoliczności których nie można było przewidzieć lub uniknąć, w tym: żywioły i katastrofy (pożar, trzęsienie ziemi, osuwanie ziemi, powódź, wichurę lub inne zjawiska atmosferyczne), pandemie, epidemie, wojny, powstania, bunty, strajki albo decyzje czy normatywne akty organów władzy, regulowanie, ograniczanie, zakazy bądź inne ingerencje państwa, wybuchy i inne uszkodzenie urządzeń produkcyjnych i dystrybucyjnych oraz ogólnokrajowe awarie sieci internetowej.

Strona umowy, która nie spełnia lub przewiduje, że nie spełni swojego zobowiązania, wynikającego z umowy (z uwzględnieniem wszystkim znanych faktów) z powodu zaistniałej siły wyższej, powinna niezwłocznie poinformować o tym drugą stronę umowy i dołożyć wszelkich starań do odwrócenia takiego stanu lub jego następstw i ich usunięcia.

§ 9 Personal data protection

The administrator of personal data is: Freelance Management Group, a limited liability partnership, based in 411 Oxford Street, London, W1C 2PE, United Kingdom, company number OC443813.

The administrator processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR), tailored by the Data Protection Act 2018.

The data is processed only for the purpose of providing the service referred to in the Regulations.

Detailed information on the processing of personal data is set out in the "Privacy Policy" tab available on the Website, which is an integral part of these Regulations.

Administratorem danych osobowych jest: Freelance Management Group partnerstwo z ograniczoną odpowiedzialnością z siedzibą w Londynie, 411 Oxford Street, W1C 2PE, Wielka Brytania, numer rejestracyjny firmy OC443813.

Administrator przetwarza dane osobowe zgodnie z brytyjskim ogólnym rozporządzeniem o ochronie danych osobowych (UK GDPR), ustawa o ochronie danych z 2018. Dane przetwarzane są wyłącznie w celu realizacji usługi, o której mowa w Regulaminie.

Szczegółowe informacje dotyczące przetwarzania danych osobowych określone zostały w zakładce „Polityka prywatności", dostępnej na Stronie Internetowej, która to stanowi integralną część niniejszego Regulaminu.

§ 10 Provision of services by electronic means

§ 10 Świadczenie usług drogą elektroniczną

The Ordering Party may use the services via the Website, subject to the following technical conditions of the ICT system:

access to the Internet and an active e-mail account,

using browsers: ……………… in version …………………………… with up-to-date versions of Java and Flash installed,

on screens with a resolution of ........................... px,

The use of third party software that affects the functioning and functionality of browsers or the use of mobile devices may affect the correct display of the Website.

Zamawiający może korzystać z usług za pośrednictwem Strony internetowej z zastrzeżeniem spełnienia następujących warunków technicznych systemu teleinformatycznego:

dostęp do sieci Internet i czynnego konta poczty elektronicznej,

przy pomocy przeglądarek: ……………… w wersji …………………………… z zainstalowanymi aktualnymi wersjami Java i Flash,

Używanie oprogramowania firm trzecich mających wpływ na funkcjonowanie i funkcjonalność przeglądarek lub korzystanie z urządzeń mobilnych może mieć wpływ na poprawne wyświetlanie Strony internetowej.

The Ordering Party's use of the Website by means of other means of distance communication is associated with the necessity to bear the connection costs. The above fees are not collected by the Contractor, but by the provider of publicly available telecommunications services within the meaning of the Communications Act 2003 (as amended by the Telecommunications (Security) Act 2021) , whose services are used by the Ordering Party. The cost of calls is charged according to the tariffs of the telecommunications operator.

Korzystanie przez Zamawiającego ze Strony internetowej za pomocą innych środków porozumiewania się na odległość jest związane z koniecznością poniesienia przez niego kosztów połączenia. Powyższe opłaty nie są pobierane przez Wykonawcę, ale przez dostawcę publicznie dostępnych usług telekomunikacyjnych w rozumieniu Ustawy o Komunikacji z 2003 r. (z późniejszymi zmianami Ustawy o Telekomunikacji (Bezpieczeństwo) 2021), z którego usług korzysta Zamawiający. Koszt połączeń naliczany jest według taryf operatora usług telekomunikacyjnych.

The Ordering Party is prohibited from providing illegal content.

The Contractor takes steps to ensure the proper operation of the Website, to the extent that results from the current technical knowledge and undertakes to immediately remove defects or interruptions in its functioning.

The Contractor is not responsible for improper performance of the services in the event of technical problems beyond the Contractor's control.

The Ordering Party should immediately notify the Contractor of any defects or interruptions in the functioning of the Website by submitting a complaint in writing to the Contractor's address or via e-mail. The Contractor shall consider the complaint within 14 days from the date of its receipt, informing the Employer immediately about its results.

Zakazuje się Zamawiającemu dostarczania treści o charakterze bezprawnym.

Wykonawca podejmuje działania w celu zapewnienia poprawnego działania Strony internetowej, w takim zakresie, jaki wynika z aktualnej wiedzy technicznej i zobowiązuje się usuwać niezwłocznie wady lub przerwy w jego funkcjonowaniu.

Wykonawca nie ponosi odpowiedzialności za niepoprawne wykonanie usług w przypadku zaistnienia problemów technicznych, niezależnych od Wykonawcy.

Zamawiający powinien niezwłocznie powiadomić Wykonawcę o wszelkich wadach lub przerwach w funkcjonowaniu Strony internetowej, zgłaszając reklamację pisemnie na adres Wykonawcy lub za pośrednictwem poczty elektronicznej. Wykonawca rozpatrzy reklamację w terminie nie dłuższym niż 14 dni od daty jej wpływu, informując Zamawiającego niezwłocznie o jej wynikach.

The Contractor reserves the right to amend the Regulations in the event of:

organizational or legal changes at the Contractor,

changes in the applicable legal provisions applicable to these Regulations or changes in the practice of applying the law,

development of internet technologies and changes in the functionality of the Website, when the changes to the Regulations are aimed at adapting the content of the Regulations to this functionality,

changes to the rules of using the services or the Website

- with the proviso that orders placed before the entry into force of these changes will be implemented according to the current rules.

Niniejszy Regulamin obowiązuje od dnia 02.03.2022 r.

Aktualny Regulamin publikowany jest na Stronie Internetowej w zakładce „Regulamin".

Wykonawca zastrzega sobie prawo zmiany Regulaminu w przypadku:

zmian organizacyjnych lub prawnych u Wykonawcy,

zmiany obowiązujących przepisów prawa mających zastosowanie do niniejszego Regulaminu lub zmiany praktyki stosowania prawa,

rozwoju technologii internetowych i zmiany funkcjonalności Strony internetowej, gdy zmiany Regulaminu mają na celu dostosowanie treści Regulaminu do tej funkcjonalności,

zmiany zasad korzystania z usług lub ze Strony internetowej

- z zastrzeżeniem, że zamówienia złożone przed wejściem w życie tych zmian będą realizowane za zasadach dotychczasowych.

Nie stanowi zmiany Regulaminu: zmiana zawartych w nim danych teleadresowych dotyczących Wykonawcy ani zmiana jego danych wynikająca ze zmiany formy prawnej prowadzenia przez niego działalności.

Szczegółowe informacje dotyczące możliwości skorzystania przez konsumenta z pozasądowych sposobów dochodzenia roszczeń oraz zasady dostępu do tych procedur dostępne są m.in. w siedzibach oraz na stronach internetowych Urzędu Konkurencji i Konsumentów, powiatowych (miejskich) rzeczników konsumentów, organizacji społecznych, do których zadań statutowych należy ochrona konsumentów.

Wszelkie spory powstałe na gruncie niniejszego Regulaminu lub Umowy, których Stronom nie uda się w pierwszej kolejności rozwiązać ugodowo, podlegają następnie rozstrzygnięciu przez sąd powszechny właściwy miejscowo dla siedziby Wykonawcy, a w odniesieniu do Konsumentów, sąd powszechny właściwy zgodnie z ogólnymi zasadami określonymi przepisami Kodeks postępowania cywilnego z 1998 r.
